Terms of Service

These terms govern your use of Kontextual: our mobile app, web app, and the public pages we generate for your digital cards and contact-capture lists (collectively, the "Service"). Kontextual is operated by Daniel Babalola, an individual based in Ontario, Canada. By using the Service, you agree to these terms.

Your account

You're responsible for the accuracy of the information you add to your account and for keeping your account secure. You must be at least 16 years old to use Kontextual.

Responsible relationship capture

Kontextual is designed to help professionals organize legitimate business and professional relationships. You may not use the Service to collect personal information unlawfully, impersonate another person, harvest contact information without permission, send unsolicited communications, or otherwise violate applicable privacy laws.

If you use a public capture form, you are responsible for providing any notices and obtaining any consents required under applicable law for the people submitting information through it.

Information about other people

Kontextual stores information about people you meet, not just you. Before adding, enriching, messaging, or exporting someone else's personal information through Kontextual, you must have an appropriate legal basis or their permission to do so. Don't upload sensitive personal information about others (such as health, financial, or government-ID information) through Kontextual.

AI-generated content

Business card scanning and other AI-assisted features may produce suggestions, extracted data, or summaries that are incomplete or inaccurate. You remain responsible for reviewing this information before saving, sharing, or relying on it.

Acceptable use

• Don't use the Service to send spam, unsolicited marketing, or to harass anyone whose information you've captured.
• Don't attempt to access another user's account, contacts, or cards without authorization.
• Don't scrape, harvest, or use automated means to extract data from public Kontextual pages beyond normal browsing.
• Don't upload unlawful, infringing, or abusive content to a digital card or any other part of the Service.
• Don't reverse-engineer, resell, or use the Service to build a competing product.

Public pages

Digital cards you publish and list-capture forms you create are intentionally public. Anyone with the link or QR code can view or submit to them until you remove or disable them. You're responsible for what you put on a public card and for how you use information submitted through your capture forms, including complying with applicable privacy and marketing laws for your audience.

Your content and licence to us

You retain ownership of the content you upload: logos, photos, and other material added to your digital cards or contacts. By uploading it, you grant Kontextual a limited licence to host, store, and display that content solely to operate the Service on your behalf.

Subscriptions

Some features require a paid subscription. Subscriptions are purchased, billed, and managed through the Apple App Store according to your App Store account settings, including renewal and cancellation. Manage or cancel anytime in Settings → your name → Subscriptions on your device. Refunds for App Store purchases are handled exclusively by Apple. Plan availability, pricing, and limits are described in the app and App Store listing at the time of purchase and may change with notice.

Suspension and termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these terms, pose a security risk, or as required for legal compliance. To request deletion of your account, see our Privacy Policy.

Service availability

We aim to keep Kontextual reliable but don't guarantee uninterrupted availability. We may modify or discontinue features with reasonable notice where practical.

Disclaimer & limitation of liability

The Service is provided "as is" without warranties of any kind. To the extent permitted by law, Kontextual is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be subject to the exclusive jurisdiction of the courts of Ontario. These terms don't require arbitration.

Changes to these terms

We may update these terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised terms.
